A New York judge has granted Donald Trump permission to request the dismissal of his hush money criminal case, following his victory in the November 5 US presidential election. Trump, 78, had been scheduled for sentencing on November 26 after being found guilty earlier this year. However, Manhattan District Attorney Alvin Bragg’s office recently asked New York State Supreme Court Justice Juan Merchan to postpone proceedings until after Trump’s upcoming four-year presidential term, which begins on January 20.
Trump’s legal team, led by the Republican former president, argued that proceeding with the case while he holds office would create “unconstitutional impediments” to his ability to govern. While prosecutors plan to oppose the dismissal, they agreed Trump should have the opportunity to present his arguments through written motions.
Justice Merchan set a December 2 deadline for Trump to file his motion to dismiss, with prosecutors having until December 9 to respond.
