President Dr Arif Alvi penalized the accused in a sexual harassment case by imposing the air travel expenses of the complainant upon the accused due to filing groundless representations in haste, in an effort to deter frivolous litigation.
The president also imposed a fine on the accused for causing the alleged victim further emotional and financial distress by requiring her to travel from Karachi to Islamabad with her legal representative to attend the hearing.
The case involved a female assistant sub-inspector (ASI) employed by the Airport Security Force (ASF) in Sukkur, who accused the airport manager of harassing her. According to the complainant, the accused had forced her into marriage, but after four months, he began mistreating her and gave her a divorce in February 2022. She also alleged that the accused threatened to ruin her job if she refused to live with him.
Furthermore, the accused was reported to have sent the complainant inappropriate messages on WhatsApp. The complainant filed a complaint with the Federal Ombudsman for Protection against Harassment of Women at Workplace (FOSPAH).

During the proceedings, the accused filed an application to dismiss the complaint on the grounds that the allegations were unclear and related to personal matters.
To discourage false and groundless litigation, the president’s decision to impose the complainant’s air travel costs on the accused is a strong message to those who file frivolous cases.
