UN Report Condemns India’s Unilateral Actions Against Pakistan

A recent United Nations report by Special Rapporteurs and independent experts has strongly condemned India’s use of military force inside Pakistan following the Pahalgam attack, calling it a violation of international law and a threat to life and security. The report, finalized on October 16 and released on December 15, noted that India’s strikes lacked any lawful self-defence basis and risked escalating tensions between two nuclear-armed neighbours.

The April 22 Pahalgam attack killed 26 civilians, triggering India’s May 7 retaliation. The UN experts highlighted that India provided no evidence linking Pakistan to the attack, yet used the allegation to justify cross-border military action. Strikes targeted populated areas and religious sites, raising serious concerns about civilian protection and respect for religious property. The experts emphasised that unilateral counter-terror measures are not recognised under international law and that India did not notify the UN Security Council, a procedural requirement under Article 51 of the UN Charter.

The report also criticised India’s decision to place the Indus Waters Treaty “in abeyance,” calling it unlawful and potentially harmful to millions of Pakistanis reliant on water for food, health, and livelihoods. Experts noted that treaty disputes require established settlement mechanisms, and India’s claims of material breach or cross-border terrorism do not meet the legal threshold for suspension.

President Asif Ali Zardari welcomed the report, stating it reinforces Pakistan’s position that unilateral use of force and bypassing treaty obligations are violations of sovereignty and international law. He warned that India’s pattern of rogue behaviour, including disregard for minorities and UN commitments, cannot continue without accountability. The report underscores the urgent need for lawful dispute resolution, respect for human rights, and adherence to international agreements to prevent escalation and safeguard regional stability.
