The Pakistan Bar Council (PBC) has suggested an amendment to Article 68 of the Constitution that would enable discussions in parliament about decisions made by the Federal Constitutional Court (FCC) under the 26th Constitutional Amendment Bill. This proposal, if accepted, would replace the current exclusion of the Supreme Court and high courts from Article 68, allowing for parliamentary scrutiny of judicial conduct by FCC judges.
Additionally, the PBC has recommended various amendments to other articles, including provisions for parliamentary scrutiny of FCC rulings, changes to the composition of the Judicial Commission of Pakistan (JCP), and adjustments to the retirement age of FCC judges.
Furthermore, the PPP has been briefing civil society groups and key stakeholders on their proposed policy regarding the FCC, emphasizing the importance of inclusive consultations and consensus-building in establishing the Federal Constitutional Court.
