Supreme Court Removes Controversial Paragraphs from Verdict on Mubarak Sani Case

The Supreme Court made a decision to remove certain paragraphs from its previous verdict on the Mubarak Sani case after considering a review plea filed by the federal government. The decision was made by a three-member bench led by Chief Justice Qazi Faez Isa and comprising of Justice Irfan Saadat Khan and Justice Naeem Akhtar Afghan.

The case involved the overturning of the conviction of Mubarak Sani, who was accused of sacrilege. The court noted that the offense he was accused of had not been criminalized until 2021, leading to the setting aside of the conviction and ordering his immediate release.

Following the verdict, there was significant public outrage, prompting the federal government and the Punjab government to file petitions seeking amendments to the court’s decision. The petitions argued that certain parts of the judgment seemed to be inconsistent with previous rulings of the highest court. Religious scholars also joined the proceedings, requesting the court to revise the verdict.

During the hearing, the Chief Justice expressed willingness to correct any mistakes made, acknowledging the importance of adhering to religious references in judicial decisions in an Islamic state. As a result, the court decided to remove certain paragraphs from the verdict and stated that these paragraphs could not be cited as precedent in any future judgments.

Following the court’s decision, religious scholars welcomed the verdict and announced plans to observe a ‘thanksgiving day’ to celebrate the judgment.
