Trump vs. Merchant: Lawyers Accuse Judge of Partiality, Demand Disqualification

Former President Donald Trump’s legal team has made a bold move, calling for Judge Juan Merchan to step aside from overseeing Trump’s criminal case. They assert that Merchan’s alleged bias and potential conflict of interest demand his recusal.

Trump’s attorneys contend that Merchan’s daughter’s affiliation with Authentic, a digital agency serving Democratic officials, creates an “actual or perceived conflict of interest.” They further claim that Merchan demonstrated preconceived bias by encouraging Trump Organization’s former CFO, Allen Weisselberg, to cooperate against Trump in a prior case. In that trial, Weisselberg pleaded guilty to tax fraud, while the Trump Organization faced a guilty verdict under Merchan’s jurisdiction.

Beyond the recusal plea, Trump’s legal team demanded Merchan’s public clarification regarding political donations made in his name during the 2020 presidential campaign. Public records indicate that Merchan contributed $35 through ActBlue, supporting President Joe Biden’s campaign, the Progressive Turnout Project, and Stop Republicans. The attorneys argue that these donations raise doubts about Merchan’s ability to remain impartial.

Highlighting the significance of impartiality in this historic case, Trump’s lawyers stressed the necessity for public confidence in the overseeing judge. Accompanied by 42 pages of evidence outlining their allegations of political bias, they filed a motion urging Merchan’s recusal.
